Fre?quently when I?m talk?ing with a client about the set?tle?ment of their case they?ll ask me exactly how long will it take before they actu?ally receive their set?tle?ment check once we?ve all agreed on a set?tle?ment amount.

Hi, I?m attor?ney Rus?sell Keener, I?ve been doing Geor?gia Work?ers? Com?pen?sa?tion for over 20 years and my expe?ri?ence is that it nor?mally takes roughly about a month between when the set?tle?ment amount is agreed upon by all par?ties and when the final set?tle?ment checks actu?ally arrive.

How?ever, please real?ize that there are 3 dis?tinct groups of peo?ple involved in the process; me and my client, the employer/insurance com?pany and their lawyer and the judge?s office.

It?s dif?fi?cult to pin?point exactly when your check will actu?ally arrive because while we have con?trol over how long it takes us to do our part, we have no con?trol over how long the other two groups take to do their?part.

Basi?cally the process works like this. After there is an agree?ment as to the set?tle?ment amount the two lawyers pre?pare the doc?u?ments for your sig?na?ture. After that the doc?u?ments will be sent to the judge?s office for approval. Once all that is done the insur?ance com?pany has up to an addi?tional 20 days to get your money to you or be hit with a whop?ping 20% penalty.

So, depend?ing on how long it takes for the insur?ance com?pany to get your signed doc?u?ments over to the judge and depend?ing on how long it takes the judge to look over and approve your doc?u?ments and depend?ing on how many of the 20 days the insur?ance com?pany chooses to take after that before they mail your check will deter?mine the total length of time it will take between when we all agree on a set?tle?ment amount and when you actu?ally receive your set?tle?ment?check.

Again, while that process usu?ally takes about a month, it could be longer or it could be shorter depend?ing on these other two groups. Either way, we will notify you imme?di?ately when your doc?u?ments are sent to the judge, when the judge finally approves your set?tle?ment doc?u?ments and when your final set?tle?ment check actu?ally arrives.
