Spain requests bank aid, Moody's downgrades banks

MADRID (Reuters) - Spain formally requested a European bank rescue on Monday but lack of details kept investors fretting and Moody's cut the ratings of most Spanish lenders, citing the government's reduced ability to support them and the likelihood of higher property losses.

In a letter to Eurogroup Chairman Jean-Claude Juncker sent early on Monday, Spanish Economy Minister Luis de Guindos said he wanted to take up the EU offer of up to 100 billion euros ($125 billion) and hoped to finalize the package by July 9.

He did not specify how much money Spain will seek to recapitalize the indebted lenders and said the final amount and conditions of the assistance were still under discussion.

Ahead of reports of the Moody's downgrade, Spanish banking stocks <.iban.bc> closed down 4.9 percent on Monday, underperforming the blue-chips index <.ibex>, which fell 3.7 percent. Spain's country risk, as measured by the spread between German and Spanish benchmark bonds, rose to around 518 basis points.

Moody's downgraded the ratings of 28 of 33 rated banks, by one to four notches, following a cut to Spain's sovereign rating to just above junk status earlier this month.

"The reduced creditworthiness of the Spanish sovereign...affects the government's ability to support the banks," the credit rating agency said in a statement.

"The banks' exposures to commercial real estate will likely cause higher losses, which might increase the likelihood that these banks will require external support."

The downgrade included Spain's largest two lenders, Santander and BBVA and left the long-term debt of Bankia , which requested a bailout last month, at junk status.

Moody's said it would assess the impact of the euro zone recapitalization on banks' creditworthiness and bondholders once details on funds to individual banks were known.

Economy Minister De Guindos said an independent audit of the banking sector released last Thursday would be used as a starting point to determine the capital needs, to which an additional security buffer will be added.

The audit showed Spanish banks, badly hit by a property crash four years ago, need up to 62 billion euros to weather a severe economic downturn.

Analysts say the euro zone's fourth largest economy, which has become the focus of the debt crisis, will struggle to get out of recession unless the banking problems are solved.

According to financial and government sources, four nationalized banks - Bankia, CatalunyaCaixa, NovaGalicia and Banco de Valencia - will get the bulk of the aid. These banks could need a cash injection of around 40 billion euros as soon as July, the sources said.

The bailout mechanism - European Stability Mechanism or European Financial Stability facility - which will be used to raise the money will be chosen at a later stage.

This choice is important because the ESM has a preferred debtor status which would push private bondholders down the queue for repayment of their investments.

NO LOSSES FOR BONDHOLDERS

Luxembourg Prime Minister Jean-Claude Juncker, who chairs monthly meetings of euro zone finance ministers, said he had received the request and would give an answer "in due course".

"We expect to give a mandate to the Commission, in liaison with the ECB and the EBA, to negotiate the necessary policy conditionality for the financial sector, including restructuring plans in accordance with EU state aid rules, which shall accompany the financial assistance," he said in a statement.

The European Commission usually requires banks which receive aid to sell assets, close branches and restructure.

This would, however, not involve imposing losses on banks' bondholders, something De Guindos ruled out on Friday.

Secretary of State for Economy Fernando Jimenez Latorre said on Monday the aid should reach the banks within three or four months and that transitory liquidity mechanisms would be used for the entities which require a lifeline earlier.

"In the next weeks, we will clear doubts about the seniority of the European aid, the conditions for the credits, the maturity, if it will affect the deficit," he said.

He added that the possibility of channeling the European aid directly to the banks was still an option. The request letter, however, said Spain's bank restructuring fund, known as the FROB, would receive the money and distribute it to the lenders.

DIRECT AID?

Documents released on Friday after the independent audit showed Spain will carry out yet another stress test of its banks by October with a focus on seven lenders that might not need aid right away but could still be vulnerable.

Doing the extra test gives Spain at least two more months to negotiate for direct recapitalization of the banks. The government wants to avoid taking on the aid itself and then channeling it to the banks, which would affect the public debt, potentially ramping up borrowing costs and dragging it further into the debt crisis.

Foreign Minister Jose Manuel Garcia-Margallo said on Monday that Spain would insist on having long maturities and low interest rates on the loans. He also said direct European aid for the banks was still an option.

Spain has escaped conditionality for its economic policy in return for the financial assistance but it will be placed under increased scrutiny from its EU partners.

"The way Spain complies with any and all of its commitments will be looked at with more attention than for a country which has not sought financial assistance," said EU competition chief Joaquin Almunia on Monday.

Almunia will be in charge of supervising the restructuring of the banking sector and maintaining a level playing field with other lenders in Europe which did not receive state aid.

The public treatment of private philanthropy is topical, with Britain's Chancellor of the Exchequer George Osborne using his budget speech in March to argue tax breaks to wealthy donors were overly generous and unfair.

Osborne's argument is the cost of the exemption is borne by the rest of the population in the form of higher taxes.

Britain is not alone in re-assessing incentives with the Obama administration also questioning revenue impact amid moves to limit the amount of giving that can be deducted from taxable income.

For Australia, currently in the throes of charitable sector reform, Thomas says additional red tape will be counterintuitive and that legislative changes miss the point of why people give - predominately for personal reasons.

Know your BMI: Docs urged to screen for obesity

(AP) ? Chances are you know your blood pressure. What about your BMI?

Body mass index signals if you're overweight, obese or just right considering your height. Some doctors have begun calling it a vital sign, as crucial to monitor as blood pressure.

But apparently not enough doctors check: A government panel renewed a call Monday for every adult to be screened for obesity during checkups, suggesting more physicians should be routinely calculating their patients' BMIs.

And when someone crosses the line into obesity, the doctor needs to do more than mention a diet. It's time to refer those patients for intensive nutrition-and-fitness help, say the guidelines issued by the U.S. Preventive Services Task Force.

Don't assume your weight's OK if the doctor doesn't bring it up.

Patients "should be asking what their BMI is, and tracking that over time," says task force member Dr. David Grossman, medical director for preventive care at the Group Health Cooperative in Seattle.

The advice sounds like a no-brainer, considering the national anxiety about our growing waistlines. Two-thirds of adults are either overweight or obese. Some 17 percent of children and teens are obese, on the road to diabetes, heart disease and other ailments before they're even grown.

The task force has recommended adult obesity screening previously, and similar guidelines urge tracking whether youngsters are putting on too many pounds.

Yet BMI remains a mystery for many people. A 2010 survey of members of the American Academy of Family Physicians found up to 40 percent of those primary care doctors were computing their patients' BMIs. Surveys show only about a third of obese patients recall their doctor counseling them about weight loss, even though people whose doctors discuss the problem are more likely to do something about it.

Doctors can struggle with the pounds, too, and Johns Hopkins University researchers recently reported that overweight physicians were less likely than skinnier ones to advise their patients about weight loss.

Why the reluctance? One reason: Few doctors are trained to treat obesity, they're discouraged by yo-yo dieting but they don't know what to advise, says Dr. Glen Stream, president of the physicians' group. His Spokane, Wash., practice uses electronic medical records that automatically calculate BMI when a patient's height and weight is entered.

"Our American culture is always looking for an easy fix, a pill for every problem," Stream says. "The updated recommendation is important because it makes clear exactly what doctors should do to help."

In Monday's Annals of Internal Medicine, the task force concluded high-intensity behavioral interventions are the best non-surgical advice for the obese, citing insufficient evidence about lasting effects from weight-loss medications.

The task force's Grossman says a good program:

?Includes 12 to 26 face-to-face meetings over a year, most in the first few months.

?Makes patients set realistic weight-loss goals. Losing just 5 percent of your initial weight ? 10 pounds for a 200-pound person ? can significantly improve health.

?Analyzes what blocks each patient from reaching those goals. Do they eat high-calorie comfort foods to deal with depression? Spend too much time at a desk job?

?Tailors ways to help people integrate physical activity into their daily routine.

?Requires self-monitoring, such as a food diary or a pedometer to track activity.

Last year, Medicare started paying primary care doctors for obesity screening and weight-loss counseling for seniors for a year, including weekly meetings for the first month.

But many insurance companies don't pay for all the suggested interventions, and comprehensive programs aren't available everywhere, says Dr. Scott Kahan of George Washington University and the STOP Obesity Alliance. He runs a clinic that provides a medical, psychological and nutritional evaluation before tailoring a plan. In other programs, primary care doctors may offer some counseling and send patients to nutritionists or other specialists for extra help.

Another problem: "Doctors tend to shoo away people who have obesity. They say, 'Don't come back to me and tell me your back hurts or you have acid reflux or high cholesterol until you will do something about it,'" laments Kahan, who is teaching medical school students to motivate patients.

What about the overweight? The task force said more study is needed on how best to help them.

But in Reno, Nev., Dr. Andy Pasternak calculates BMI for every patient at his family medicine practice ? and particularly targets the overweight in their 40s and younger for fitness counseling. He says if they wait until they're heavier or older to get active, arthritis exacerbated by the pounds will be another barrier.

Patients seldom know what their BMI should be, but "at least twice a day people say, 'What should be my optimal weight?'" Pasternak says.

He thinks saying to lose 60 pounds is too discouraging: "What I try to get them to focus on is: How much are you working out? How many servings of vegetables do you get a day?"

"Hey, lady. You, lady. Cursing at your life."? Charlene, "I've Never Been to Me"

Charlene's ancient AM-radio lyric sounded unexpectedly in my head as I savored "Why Women Still Can't Have It All," Anne-Marie Slaughter's charming and tautological cover story in this month's The Atlantic.

I like pieces like Slaughter's. Truism after truism. Good June beach reading: no surprises. But there was that early-'80s melody again.

In the article, Slaughter?a hardworking professor with a bruising speaking schedule who didn't quit working to hang out with her teenage sons but sort of thought about it?reflects on how other women bug her. She admits that she can't be in Washington, D.C., and Princeton, N.J., at the same time (the laws of physics bind her, too). And then she says some sensible-sounding stuff about technology and society.

The article appears to weigh in on the warring spheres that middlebrow women's magazines typically refer to as "work" (cubicles) and "family" (child care). But The Atlantic is not Redbook?and these up-for-grabs words mean something different here. I'd say Slaughter's version of "work" is more widely known as "glamour" (cocktails with Michelle Obama) and her "life" is better described as "deluxe domesticity" (waffles in Princeton, N.J.).

How can you have the fantasies of both Vogue and Elle D?cor?! This turns out to be an urgent question for well-heeled female consumers of our time.

"Hey lady, you lady," Slaughter implores, to the many women around her whose "irksome" small-talk about kids and jobs (you're a feminist-antifeminist-go-to-work-stay-home!) evidently inspires "blind fury" in her. Do as I say, she tells them, not as I do.

That's generous of Slaughter, to give advice. A larger-than-life superstar at the summit of American career success with what sounds like an awesome fun family, Slaughter admits to having spent her life as "the woman smiling the faintly superior smile" at other women.

Slaughter acted smug in the sisterhood: That's a good-enough confession, not quite a #humblebrag. At the same time, who can blame her? Slaughter, who is preceded everywhere she goes by her reputation as a top-caliber Ivy League academic, friend of Hillary and left-wing policymaker of the first rank, is objectively superior to everyone I've ever met. I'm not kidding. If she ever smiled superiorly at me, I'd be grateful even for the condescension.

But now she's penitent.

Slaughter, it seems, has been to paradise. She held a "foreign-policy dream job that traces its origins back to George Kennan." A snapshot of that dream: "President and Mrs. Obama hosted a glamorous reception at the American Museum of Natural History. I sipped champagne, greeted foreign dignitaries, and mingled."

But mingling, too, in the heady evening, were stray thoughts of Slaughter's teenage son in Princeton, who wasn't doing so well in math class. Was she letting him down by partying with presidents in Manhattan? Moreover, what did Slaughter want out of her one wild and precious life?

This last part hit Slaughter hard. In an interview that appears on The Atlantic site, she tells Hanna Rosin how hard it was for her to think?and write!?about her true desires. It seems she had "never been to me," as Charlene put it. And she needed that kind of groovy female awakening-to-desire as much as anything else.

I know this sounds far-fetched, but to my mind, that extraordinarily unsettling and ingenious Motown hit from 1982 really does set up the structure for Slaughter's piece. A woman of a certain age warns girls against the pursuit of worldliness that she believes left her estranged from domesticity and true female fulfillment.

Slaughter's article unfurls the indisputable fact in its "Women Still Can't Have It All" headline?infinite acquisition and possession of all things by one woman is impossible?over many, many pages of magazine prose. That dilation is dumbfounding. That fact about not-having-it-all is binding on all mortals, is it not? But Slaughter is a distinguished professor of law at Princeton University; she knows from sophistry and Socratic argumentation.

That's how I divined that her article is about something else. I'm going to summarize it this way, in Charlene's blunt internally rhyming lyric: "I spent my life exploring/ the subtle whoring/ that costs too much to be free."

Sure, "whoring" is not a Princeton word. It's Motown. But aren't Slaughter and Charlene (whose song was written by a man and originally in the voice of a bum warning a young man against hard living) telling the same story? They whirled around while they were younger?both women have champagne and "foreign dignitaries" in their stories?and now they're spent. They're hoping that the humbler pleasures of home and hearth haven't forsaken them while they've sewn oats in international careers. Totally understandable.

While she sipped champagne at the U.N. with those dignitaries, Slaughter worried about her son's "skipping homework, disrupting classes." Charlene's speaker, for her part, took her champagne on yachts with kings. At the same time, she mourned "the unborn children that might have made me complete."

For its sideswiping of abortion rights and sappiness about home life, "Never Been to Me" was considered a backlash against feminism. Thirty years later, Anne-Marie Slaughter's pals hint that she too is insufficiently feminist when she decides not to re-up her White House job that required her to see her family on weekends, but merely to return (as planned) to her wickedly demanding career as a chaired academic and author.

But then comes the crux of Slaughter's article, truisms swelling as they do in any good Polonian magazine-piece ending. "I didn't just need to go home. Deep down, I wanted to go home. I wanted to be able to spend time with my children ... irreplaceable years for me to enjoy the simple pleasures of parenting?baseball games, piano recitals, waffle breakfasts, family trips, and goofy rituals."

Compare that major-chord finale with Charlene's?spoken, as Slaughter's certainly could be, over an extended bridge in a slightly hysterical but sweet soprano:

"Hey, you know what paradise is? It's a lie?a fantasy we created about people and places as we like them to be. But you know what truth is? It's that little baby you're holding and it's that man you fought with this morning the same one you are gonna make love to tonight."

"That's truth, that's love!" cries Charlene. And I'm with her.

I guess I'm with Slaughter, too. But that's the thing about clich?s. They just hang around until someone puts them to music, gets a Motown producer?or an editor in D.C. and some cover art?and manages a breakout summer hit.

Arianna Huffington: The Slow News Movement

Each year, the Cannes Lions International Festival of Creativity gathers thousands of innovative thinkers and practitioners in advertising and media from around the world to talk about what's new and what's next in our brave new digital world. Last year I spoke about one of the most exciting developments online: the fact that the Internet has come out of its adolescent stage and is growing up into a place where our online and our offline lives have merged -- where the qualities we care most about offline are increasingly reflected in our experience online. And where, among all the random searching that defined the Internet's early years, something new has emerged: a search for greater meaning.

On Monday, I took the stage again with Roy Sekoff, HuffPost's founding editor and president of our soon-to-be-launched video streaming network, HuffPost Live. And what was on my mind was the speed with which the Internet is heading in this new direction. A world of too much data, too many choices, too many possibilities and too little time is forcing us to decide what we really value. And, more and more, people and innovative companies are recognizing that we actually have a life beyond our gadgets. That is why one of the most exciting features of Apple's Worldwide Developers Conference last week was Do Not Disturb, the new iPhone feature designed to get you off your iPhone altogether.

And Huffington is definitely a manifestation of this longing to disconnect from the hurly-burly of our hyper-connected lives and join the slow news movement.

So here are some of this issue's highlights: Katie Bindley on the psychology behind online romance scams; Michael Calderone on Politico's growth since its upstart days way back in the 2008 election; Sharon Carty on the young designers, engineers and scientists pumping new life into Detroit's auto industry; Peggy Drexler on the risks and rewards of raising children to believe they're all winners, all the time; Gary Hart on the possible consequences -- both legal and illegal -- of the Supreme Court's Citizens United decision; and Priyamvada Natarajan, who asks "Can Science Be Crowd-Sourced?"

There's also Mike Hogan's review of Beasts of the Southern Wild (which won big at another festival in Cannes), a Q&A with Meghan McCain, and a "Greatest Person of the Week" feature on Dr. Michael Good, a Marietta, GA, veterinarian who takes in stray animals who would otherwise have little chance of getting medical attention or being adopted.

I'm delighted that Huffington's first issue entered the world last week to great reviews. On the morning Huffington launched, I gave the commencement address at the all-girls Nightingale School in New York. I told the young women in the graduating class the story of HuffPost's birth seven years ago, and the negative reviews that greeted its arrival. You don't have to buy into the negative reviews, I told them. And just the same, you can't lean on the positive ones.

So, here at Huffington, our goal is to keep learning, keep growing, and keep listening to you, our readers, about what you want more and what you want less of. And to stay true to the qualities of storytelling, engagement, and community -- the kind of timeless qualities that, I have a feeling, will continue to resonate no matter how our online lives change.

Oil tycoon vanishes during Florida boat trip

FORT LAUDERDALE, Fla. (AP) ? When an oil tycoon's fishing boat washed ashore near Fort Lauderdale this week, the lights were on and the engines were running, but the owner was nowhere to be found.

After a two-day search, authorities suspended the hunt for Guma Aguiar, a millionaire known for his philanthropy and sometimes erratic behavior. He struggled with mental illness exacerbated by court battles with family members over his vast fortune.

His disappearance has puzzled both his family and authorities.

Surveillance video showed him talking on the phone Tuesday night outside his $5 million waterfront home, grabbing what appears to be a pair of shorts and getting into the boat alone. Seas were rough, though, and police questioned why an experienced boater such as Aguiar would venture out in undesirable conditions.

His wallet and cell phone were still on the 31-foot boat when it was discovered beached Wednesday morning about three miles from the home he shares with his wife and four children. There was no blood or signs of a struggle on the vessel, police said.

Authorities were working with the Coast Guard to analyze the boat's GPS and sifting through Aguiar's cell phone records to see if any calls were made before the boat ran aground. The search over land and water covered a combined area roughly the size of Rhode Island.

"Anything is possible. At this point it's still way too early in the investigation to jump to any conclusions," Fort Lauderdale Police Detective Travis Mandell said.

His wife told police she was worried for his safety after she came home Tuesday night and learned from the nanny that he had gone boating, but police wouldn't elaborate on why she was concerned.

Meanwhile, his mother, Ellen Aguiar, on Thursday filed to become guardian of his more than $75 million fortune, which includes $35 million in Israeli real estate, $15 million in cash, a $2 million yacht and seven cars worth more than $1 million.

Aguiar suffers from severe bipolar disorder and "may be in a delusion state or be suffering from psychosis or otherwise may have disappeared at sea," according to court documents.

On Friday, the shades were drawn at Aguiar's property and no one answered the door. His wife declined comment through a family spokesman and his mother's phone had been temporarily disconnected. Friends declined to talk on the record to The Associated Press.

Aguiar made a fortune in 2006 when the Texas-based energy company he ran with his uncle was sold for a reported $2.5 billion. But he has been locked in a contentious legal battle with his uncle over money.

His wife's attorneys said they were horrified by Ellen Aguiar's attempts to gain control of the estate, saying it has only added to the family's stress.

"She files motions in courts trying to take over everything while the divers are still out looking for Guma's body," said attorney Bill Scherer. "It's bizarre."

He planned to respond her motion, but said everything is premature right now.

Scherer said the past year was especially difficult for Jamie Aguiar, who was pregnant while her husband was hospitalized for mental illness. He moved back into the house after he was released several months ago and has been more emotionally stable since then, Scherer said.

"She's hoping that he's had another mental breakdown and that he's out there somewhere and will come walking back when he gets himself stabilized," he said.

Family members said the legal battles had taken an emotional toll on Aguiar in recent years. His family checked him into a psychiatric hospital in Tel Aviv in 2010 after claiming he entered the Gaza Strip and met with an Israeli soldier held there by Hamas militants. Aguiar's family said at the time he'd been under "intensive emotional pressures" and "psychological terrorism," because of the lawsuit.

There were other signs of trouble at home.

His wife filed a domestic violence order against him last summer. A short time later, he filed for dissolution of marriage, but both were voluntarily dismissed, according to court documents. Around that same time, his wife and mother successfully petitioned a Miami-Dade County judge to appoint an emergency guardian for him for 90 days.

In 2009, he pleaded no contest to drug charges after deputies said they found marijuana in his Bentley during a traffic stop.

Aguiar has given millions to Israeli and Jewish causes. While he was raised Christian, his mother is Jewish, and he converted to Judaism about a decade ago.

He has said he plans to rebuild the biblical Jewish temple in Jerusalem and has donated millions to a foundation that helps Jews move to Israel. In Fort Lauderdale, Chabad Lubavitch, a traditional Hasidic group, named their family campus after him.

Aguiar has been a well-known fixture in Israel since his $4 million investment saved the Israeli Premier League soccer team Beitar Jerusalem a few years ago.
